See the new E-cigarette rules in Denmark: Overview of TPD Legislation

From 7 June 2017, a new part of the e-cigarette legislation came into force, focusing on the tank or clearomizer of e-cigarettes. These must meet strict requirements and be approved before they can be sold. Here you will find a comprehensive overview of what this legislation entails.

What is TPD?

TPD stands for Tobacco Products Directive and is an EU law that applies to all e-cigarettes. Although e-cigarettes do not contain tobacco, they have nevertheless been included in this category. These rules also apply in Denmark, which has led to significant changes in the market over the past year.

E-juice Legislation

This part of TPD is already in force, and the main points include:

  • E-liquid may be sold in containers of a maximum of 10 ml.

This applies to all liquid containing nicotine. It is still possible to buy e-juice without nicotine in larger containers, as well as bases that users can mix themselves. without nicotine in larger containers, as well as bases that users can mix themselves.

  • The nicotine content in the liquid must not exceed 20 mg per ml.

Although some consumers previously used liquids with 24 or 36 mg of nicotine per ml, e-cigarette technology has fortunately advanced. With better e-cigarettes, the nicotine in the liquid is used more efficiently. Users who previously used 18 or 24 mg of nicotine now typically use 6 or 12 mg.

  • Liquids must be approved by the Safety Authority.

All nicotine-containing e-liquids must be approved before they can be sold. The Safety Authority receives and potentially approves applications from manufacturers, importers, and retailers.

 As a consumer, you can be sure that all nicotine-containing e-liquids for sale in Denmark are approved and comply with the Safety Authority's guidelines. If you are in doubt about a liquid, you can always check the Safety Authority's website for a list of approved nicotine-containing liquids.

 

Which liquids do not require approval?

Liquids without nicotine do not require approval. This includes pre-mixed liquid without nicotine, nicotine-free base, and flavourings.

E-cigarette Equipment Legislation

This part came into force on 7 June 2017, and the main points include:

  • Tank size must not exceed 2.0 ml.

When you buy a starter kit, the tank/pod must not be larger than 2 ml.

  • The tank must be childproof.

There is no standard way to make the tank childproof, but certain tanks have a "push-and-turn" function, similar to those found on household products. The essential thing is that the tank cannot be unintentionally opened, and each product is assessed individually by the Danish Safety Technology Authority.

  • The tank must be reported to the Danish Safety Technology Authority for approval.

On the Danish Safety Technology Authority's website, you will find a complete list of the reported products, and the authority is constantly working to update this list. As there are currently many applications for product approvals, a certain waiting time can be expected before the list is fully updated.
